DateWatcher Terms of Service

These Terms of Service ("Terms") govern your access to and use of the DateWatcher mobile application and related services. DateWatcher is operated by Tech Consuls LLC ("DateWatcher", "we", "us", or "our").

By creating an account, accessing, or using DateWatcher, you agree to these Terms. If you do not agree to these Terms, do not use DateWatcher.

1. About DateWatcher

DateWatcher is a personal safety tool that allows users to create Watches, schedule check-ins, receive reminders, and use certain safety escalation features.

Available features may vary depending on your plan, location, device, permissions, application version, and availability of third-party services.

2. DateWatcher Is Not an Emergency Service

DateWatcher is not an emergency dispatch service and does not replace police, fire, ambulance, 911, 112, or other local emergency services.

If you are in immediate danger, believe someone is in danger, or are experiencing a medical, police, or other emergency, you should contact the appropriate emergency services for your location directly.

You should not delay contacting emergency services while waiting for a DateWatcher notification, check-in, escalation, message, or other action.

3. No Guarantee of Safety

DateWatcher is designed to provide additional personal safety tools, but no application can guarantee your safety.

We do not guarantee that DateWatcher will prevent crime, injury, loss, emergencies, or other harmful events.

You should always exercise your own judgment, take reasonable precautions, and seek professional or emergency assistance when appropriate.

4. Watches and Check-Ins

DateWatcher may allow you to create a Watch and configure periodic check-ins. You are responsible for configuring the Watch correctly and responding to check-ins when you can safely do so.

A missed check-in does not necessarily mean that an emergency exists. Likewise, completion of a check-in does not guarantee that a person is safe.

5. Notifications and Escalation

DateWatcher may use push notifications, SMS, or other communication methods as part of its check-in and escalation functionality.

We do not guarantee that a notification, alert, SMS message, location, or other communication will be sent, delivered, received, read, or acted upon within any particular period of time or at all.

Communications may be affected by factors outside our control, including internet connectivity, cellular coverage, device battery, permissions, device settings, operating-system restrictions, Apple services, telecommunications providers, and other technical disruptions.

6. Location Information

Certain DateWatcher features may use your device's location. You must provide the necessary permissions to use these features.

Location information may be inaccurate, outdated, or unavailable due to device limitations, GPS, wireless networks, permissions, or other factors.

You should not rely exclusively on DateWatcher to determine or communicate your location during an emergency.

7. Emergency Contacts

If DateWatcher allows you to add emergency contacts, you are responsible for providing accurate information and keeping it current.

By providing another person's contact information, you represent that you have permission or another appropriate lawful basis to provide and use that information for the features you configure.

DateWatcher does not guarantee that an emergency contact will be available, receive a communication, respond, or take any action.

8. Eligibility and Accounts

You must be at least 13 years old to use DateWatcher. If the laws of your jurisdiction require a higher age to use DateWatcher or agree to these Terms, you must satisfy that requirement.

You are responsible for maintaining the security of your account and the authentication information associated with it.

You must provide accurate information and keep information important to the operation of safety features current.

9. Acceptable Use

You may not use DateWatcher to:

• Violate any applicable law or regulation
• Harass, threaten, stalk, or harm another person
• Track or monitor another person without authorization
• Intentionally provide false emergency or safety information
• Interfere with the security, infrastructure, or operation of DateWatcher
• Attempt to gain unauthorized access to accounts, systems, or data
• Use DateWatcher for fraudulent, abusive, or unlawful purposes

10. DateWatcher+

DateWatcher may offer certain features through a paid subscription called DateWatcher+.

Available subscription features, prices, and subscription periods will be displayed in the application before you complete a purchase.

11. Apple Purchases and Billing

DateWatcher+ purchases made within the iOS application are processed and billed by Apple through the App Store.

Payment will be charged to your Apple account in accordance with Apple's terms and procedures.

Subscriptions may automatically renew unless canceled in accordance with the rules and timeframes displayed by Apple.

You can manage or cancel your subscription through your Apple account's subscription settings.

Deleting your account or uninstalling DateWatcher does not automatically cancel your App Store subscription.

12. Refunds

Refund requests relating to purchases made through the App Store are administered by Apple and are subject to Apple's policies and applicable law.

13. Privacy

Our handling of personal information is described in the DateWatcher Privacy Policy. By using DateWatcher, you acknowledge that your information will be handled in accordance with that policy.

14. Third-Party Services

DateWatcher relies on services and technologies provided by third parties, which may include Apple, cloud infrastructure providers, telecommunications networks, and other providers.

We do not completely control these services and cannot guarantee their availability, accuracy, or uninterrupted operation.

15. Service Availability and Changes

We may modify, update, suspend, or discontinue DateWatcher features when reasonably necessary, subject to applicable law.

We do not guarantee that DateWatcher will be continuously available, uninterrupted, or error-free.

16. Suspension and Termination

We may suspend or terminate access to DateWatcher if we reasonably believe an account is being used fraudulently, abusively, unlawfully, dangerously, or in violation of these Terms.

You may also stop using DateWatcher and request deletion of your account, subject to our Privacy Policy.

17. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DATEWATCHER IS PROVIDED "AS IS" AND "AS AVAILABLE."

To the maximum extent permitted by law, we disclaim express or implied warranties relating to DateWatcher, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

18. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TECH CONSULS LLC, DATEWATCHER, AND THEIR OWNERS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE DATEWATCHER.

This includes, to the extent permitted by law, damages related to delayed or undelivered notifications, inaccurate or unavailable location information, service interruptions, communication failures, or the acts or omissions of third parties.

Some jurisdictions do not permit certain exclusions or limitations of liability, so some of these limitations may not apply to you.

19. Indemnification

To the extent permitted by law, you agree to indemnify and hold Tech Consuls LLC harmless from claims, liabilities, losses, and reasonable expenses arising from your unlawful or abusive use of DateWatcher or a material violation of these Terms.

20. Governing Law

These Terms will be governed by the laws of the United States, without regard to its conflict-of-law principles, except where applicable law requires otherwise.

21. Apple Terms

You acknowledge that these Terms are between you and Tech Consuls LLC, not Apple. Tech Consuls LLC, not Apple, is responsible for DateWatcher and its content, subject to these Terms.

Apple has no obligation to provide maintenance or support services for DateWatcher, except to the extent required by applicable law.

Apple and its subsidiaries are third-party beneficiaries of these Terms to the extent required by applicable App Store terms.

22. Changes to These Terms

We may update these Terms as DateWatcher changes or as legal, regulatory, or operational requirements evolve.

When we make changes, we will update the "Last updated" date shown above. Where required, we will provide additional notice of material changes.
